We hope you enjoy your visit and / or use of the Services. By visiting the Website and / or using the Services, you agree to be bound by the terms of the present agreement, known as the Terms of Use (the “TOU”).

 

The TOU were last modified on October 23, 2018. The Montreal Alouettes reserves the right, at any time and without prior notice, to modify or replace any of the TOU. Any changes to the TOU can be found in this document. It is your responsibility to check the TOU periodically for changes. Your use of the Services following the posting of any changes to the TOU constitutes acceptance of those changes. The TOU should be read in conjunction with the Privacy Policy, as both these documents govern your use of the Services. Where you use the Ticketing System through the Services, you are also bound by the Purchase Agreement for Tickets.

GENERAL CODE OF CONDUCT FOR USE OF THE SERVICES

By using the Services, you agree to:

(i)     Not use the Services in any manner that in any way violates these TOU;
(ii)    Not use the Services in any manner that violates any intellectual property rights of any third party;
(iii)   Not use the Services in any manner to propagate spam, including but not limited to unsolicited advertising or bulk electronic mail or messages, including to link to a spam or phishing website;
(iv)   Not use the Services in any manner to propagate software viruses, Trojan horses, worms, or any other malicious or non-malicious computer code, files, or programs that are designed or intended to disrupt, damage, limit or interfere with the proper function of any software, hardware, or telecommunications equipment in any form whether belonging to the Montreal Alouettes or a third party, or to damage or obtain unauthorized access to any system, data, password or other information of the Montreal Alouettes, other Montreal Alouettes users, or any other third party;
(v)    Not: (1) take any action that imposes or may impose (as determined by the Montreal Alouettes in its sole discretion) an unreasonable or disproportionately large load on the Montreal Alouettes (or its third party providers’) infrastructure; (2) interfere or attempt to interfere with the proper functioning of the Services or any activities conducted on the Services; (3) bypass any measures the Montreal Alouettes may use to prevent or restrict access to the Services or any element thereof; (4) use manual or automated software, devices, or other processes to “crawl” or “spider” any page of the Website; or (5) harvest or scrape any content from the Services in an unreasonable manner;
(vi)   Use the Services in compliance with all applicable local, state / provincial, national, and international laws.

EXTERNAL LINKS

From time to time the Montreal Alouettes may provide links to other websites or services. Links from the Services may take you to websites or services not covered by these TOU. When you access third party resources on the Internet in this manner, you do so at your own risk. The Montreal Alouettes provides those links as a convenience to you and the Montreal Alouettes takes no responsibility for your use of  those other websites or services or protection of your privacy on those other websites or services. We encourage you to check the Terms of Use and / or Privacy Policy of any website or service you visit. The Montreal Alouettes do not make any claim or warranty whatsoever about the content of those websites or services to which we link.

In no way will the Montreal Alouettes be held responsible for any damages, direct or indirect, pecuniary or non-pecuniary, for your use of websites or other services that may be linked to from the Services or the information thereon, or any virus, Trojan horse, worm or other similar destructive file received as a result of your use of those websites or services, or caused by or in connection with, use of or reliance on any content, goods or services available on or through any linked-to website or service, or the actions of the operators of any such website or service.

COPYRIGHT AND INTELLECTUAL PROPERTY RIGHTS

The content, arrangement and layout of the Services, including, but not limited to, the trademarks, photos, images, text (in the form of plain text, HTML, or PDFs) and computer code are proprietary to the Montreal Alouettes, either owned or under license, and may not be copied, imitated, reproduced, displayed, distributed, transmitted, decompiled or otherwise used without the express permission of the Montreal Alouettes. Any unauthorized use of the content, arrangement or layout of the Website or Services, computer code, or images or trademarks found in the Services or any derivative works there of may violate civil or criminal laws, including but not limited to intellectual property laws, and the Montreal Alouettes may take action accordingly.

The above paragraph further applies to third party property used as part of the Services, including but not limited to third party computer code.

For the purposes of the present section, “computer code” includes source code, frameworks, CSS or JavaScript files, templates, modules, or any similar files.

INTERRUPTION OF SERVICE

From time to time, the Services may be unavailable for brief periods of time for maintenance and / or modifications to the Services. While we will endeavour to make this unavailability as brief as possible, the Montreal Alouettes shall not be held liable for any damages, pecuniary or non-pecuniary, resulting from the interruption of the normal functioning of the Services, and disclaims any responsibility thereto.

TERMINATION OF THE SERVICES

You agree that the Montreal Alouettes, in their sole discretion, with or without cause, has the right (but not the obligation) to block your IP address, or otherwise terminate your access to or use of the Services (or any part thereof), immediately and without notice, for any reason, including, without limitation, if the Montreal Alouettes believes that you have acted inconsistently with the letter or spirit of the TOU.

The Montreal Alouettes may also, in their sole discretion and at any time, discontinue providing the Services, or any part thereof, with or without notice. Furthermore, you agree that the Montreal Alouettes shall not be liable to you or any third party for any damages, pecuniary or non-pecuniary, resulting from termination of your access to the Services, or from the Montreal Alouettes termination of the Services or any part thereof.

All provisions of these TOU which by their nature should survive termination shall survive termination of the Services, including without limitation, intellectual property ownership provisions, disclaimer of warranties, indemnity and limitations of liability.

INDEMNITY

Notwithstanding any other term of the TOU or any act or failure to act by the Montreal Alouettes or its agents or subcontractors, you agree to indemnify, defend and hold harmless the Montreal Alouettes and their officers, directors, owners, partners, partnerships, principals, employees, affiliates and other related entities, servants, agents, representatives, successors and assigns from and against any damages, liabilities, costs and expenses (including reasonable attorneys’ fees), claims or demands, arising out of (i) your use of or connection to the Services or the information therein, (ii) your participation in any activities arising from the Services, (iii) your violation of, or failure to perform your obligations under the TOU or, (iv) your violation of any rights of a third party.

DISCLAIMER OF WARRANTIES

You expressly understand and agree that your use of the Services, the information therein, or any activity arising from the use of the Services is at your sole risk. The Services, or any third party materials, are provided on an « as is » and « as available » basis, and you will be solely responsible for any damage to your computer system or loss of data that results from the download, stream or access of any material obtained through the use of the Services or any other functionalities of the Services. The information provided through the Services written by Montreal Alouettes staff is known to be as accurate as possible at the time of writing, and every effort has been made to ensure that the information from the Services is as accurate and up-to-date as possible. However, certain information may change, and errors may occur, and the Montreal Alouettes is not responsible for any loss, financial or otherwise, resulting from changes or errors in information. The Montreal Alouettes expressly disclaims all warranties of any kind, whether express or implied, including, but not limited to, warranties of title and non-infringement, warranties that the Services and any third party materials will be uninterrupted, error-free, accurate, reliable and free from virus and other harmful components, and the implied warranties of merchantability and fitness for a particular purpose. The Montreal Alouettes, and its directors, employees, agents, suppliers, partners and content providers do not warrant that: (i) the Services will be secure or available at any particular time or location; (ii) any defects or errors will be corrected; (iii) any content or software available at or through the Services is free of viruses or other harmful components; or (iv) the results of using the Services will meet your requirements. Your use of the Services is solely at your own risk.

LIMITATION OF LIABILITY

You expressly understand and agree that the Montreal Alouettes shall not be liable for any direct, indirect, incidental, special, consequential, punitive or exemplary damages, including, but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses, in contract, tort, strict liability, negligence, general civil liability or any other cause of action under legal or equitable theory, relating to the Services, the information on the Services, the use of the Services, activities arising from your use of the Services, or the third party materials on the Services. This limitation of liability applies, without limitation, to any damages or injury caused by any error, omission or other failure of performance by the Montreal Alouettes, their affiliates and business partners; any interruption, defect or delay in operation or transmission, including communication line failure; any computer virus; and any theft, destruction or alteration of, or unauthorized access to or use of, any electronic records.

GOVERNING LAWS AND JURISDICTION

Use of the Services shall be governed by and construed in accordance with the laws of the Province of Quebec, Canada, in force at the time without regard to conflict of law provisions. You agree that any legal action or proceeding between you and the Montreal Alouettes shall be brought exclusively in the courts located in the Judicial District of Montreal, Quebec, Canada.

MISCELLANEOUS PROVISIONS

(i)    The TOU, in conjunction with the Privacy Policy and Purchase Agreement for Tickets (where applicable), constitute the entire agreement between you and the Montreal Alouettes with respect to your use of the Services, superseding any prior agreements between you and the Montreal Alouettes.
(ii)   The Montreal Alouettes shall not be liable for any failure to perform its obligations under the present TOU where such failure results from any cause beyond the Montreal Alouettes reasonable control, including, but not limited to, mechanical, electronic or communications failure or degradation.
(iii)  If any provision of the TOU, Privacy Policy or Purchase Agreement for Tickets (where applicable) is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavour to give effect to the parties’ intentions as reflected in the provision, and the other provisions of the TOU, Privacy Policy or Purchase Agreement for Tickets (where applicable), as the case may be, shall remain in full force and effect.
(iv) The section titles in the TOU, Privacy Policy and Purchase Agreement for Tickets (where applicable) are for convenience only and have no legal or contractual effect.

 

PURCHASE AGREEMENT

PREAMBLE

Thank you for using the Montreal Alouettes online ticketing service (the «Service»). Your purchase of Montreal Alouettes tickets through the Service  is subject to the terms of the present Purchase Agreement for tickets (the «Areement»), Terms of Use and the Privacy Policy. When reference is made to the « Agreement » it shall also include the Terms of Use and the Privacy Policy, which are incorporated by reference herein as if recited at length. If there should be inconsistencies between the present Purchase Agreement and the Terms of Use or Privacy Policy, the Purchase Agreement shall prevail.

By purchasing tickets through the Service you agree to be bound by the Agreement.

PARTIES

The parties to the Agreement (the «Parties») are:

PURCHASED TICKETS

You hereby agree to purchase and the Montreal Alouettes agrees to sell the ticket(s) (the «Ticket(s)») detailed in your Order Confirmation (as defined below). The purchase of the Ticket(s) grants the bearer the revocable license to attend the event described on the Ticket(s). No other relationship between the Parties, either expressed or implied, is created by your purchase of the Ticket(s).

ORDER CONFIRMATION

Once your order is confirmed and your payment completed, you will receive a confirmation page and/or email indicating a confirmation number (the «Order Confirmation»). You must keep your confirmation number.

If, for any reason whatsoever, you do not receive a confirmation number or if you receive an error message or encounter a service interruption, it is your entire responsibility to contact our Customer Service Department confirm whether your order has been properly processed. You are solely responsible for any problem that may occur during the purchase of Ticket(s). In such case, the Montreal Alouettes shall not be responsible for any loss (monetary or otherwise) that may result from any problem occurring during the purchase of Ticket(s) through this website, including, without limitation, the failure of a transaction to be completed or confirmed, whether through the actions of the Montreal Alouettes and /or its related entities, or a third party.

Orders will be processed only after a billing address and other billing information have been verified. Occasionally, we receive incorrect billing or credit card account information for a ticket order. This can delay the processing of the order and the delivery of the Ticket(s). In such case, the Montreal Alouettes Customer Service Department may attempt to contact you, using the information provided at the time of purchase. If the Montreal Alouettes is unable to reach you after an initial attempt, it shall reserve the right to cancel your order and sell your Ticket(s) to another customer.

OBLIGATION TO PAY

By accepting the terms of this Agreement, you agree to pay the full price of the Ticket(s) ordered, including any applicable taxes and delivery, convenience and other fees, as described on the Order Confirmation page or e-mail. Ticket(s) prices for events that occur in Canada are stated in Canadian Dollars.

REFUNDS AND EXCHANGES

You must review your Ticket selection before you submit and confirm your order. Subject to the provisions below for cancelled and/or postponed events, there are no exchanges or refunds once the Ticket(s) have been purchased.

DELIVERY

The Ticket(s) can either be delivered by regular mail, express mail or e-mail at the postal or e-mail address you indicate or, when such option is possible, by will call (pick-up). If you choose to receive the Ticket(s) by e-mail, just print your e-tickets and present them at the event. Note that certain delays and fees are applicable depending on the delivery mode you choose.

CANCELLED AND/OR POSTPONED EVENTS

When an event is cancelled or postponed the Montreal Alouettes may, at its sole and exclusive discretion, either offer you an exchange or a refund.  You have the sole responsibility of verifying if an event for which you have purchased tickets through this website is cancelled or postponed. If an event is cancelled or postponed, the Montreal Alouettes will inform you through this website about procedures for making an exchange or obtaining a refund.

If an event is cancelled, as a general rule the credit card with which you purchased the Ticket(s) will be refunded . However, the Montreal Alouettes reserves the right to decide on an alternative refund or exchange method for a particular event.

The Montreal Alouettes may change its refund and/or exchange policies at any time, at its sole and exclusive discretion.

RIGHT TO CANCEL TICKETS, REFUSE ACCESS AND EXPEL

The Montreal Alouettes reserves the right to cancel any Ticket(s) or order of Ticket(s) through this website and to institute legal proceedings against you if you breach any provision of the Agreement or this website.

The Montreal Alouettes reserves the right to request photo ID of the Ticket(s) holder.

In the event any person attending an event is judged unmanageable or exhibits behaviour which is considered inappropriate, or fails to comply with the Montreal Alouettes rules, the Montreal Alouettes reserves the right, without any refund or compensation, to terminate such person’s license to attend the event and immediately expel such person.

The Ticket(s) purchased on this website are revocable licenses and admission to a Ticket holder may be refused for any reason (or no reason) at the sole discretion of the Montreal Alouettes, its employees, agents, officers or representatives, upon refunding the Ticket’s face value.  Ticket(s) shall not be redeemable for cash.

RECORDING, TRANSMISSION AND PUBLICATION

All cameras, tape recorders and video recorders (including when incorporated in cellular phones or other mobile devices) and their use are strictly forbidden on the site of the event.

You hereby grant the Montreal Alouettes the right to use your image, likeness, actions and statements in any transmission, publication or reproduction of the event in any means or circumstances, without any further permission or compensation.

NO RESALE

Any unlawful resale of Ticket(s) is strictly prohibited.  The Montreal Alouettes reserves the right to cancel the license granted under the Ticket(s) and in connection with any fraudulent sale of such Ticket(s), without refund or other compensation.

NO PROMOTION WITHOUT PERMISSION

The Ticket(s) and may not be used for any advertising and/or promotional purposes (including contests and sweepstakes) or resold for the purposes of same without the prior written authorization of the Montreal Alouettes.

USE OF PERSONAL INFORMATION

In addition to and without limiting the generality of the provisions set out in our Privacy Policy, by purchasing Ticket(s) through this website, you expressly agree that the personal information you provide us may be used by the Montreal Alouettes or its affiliates and other persons acting on behalf of the Montreal Alouettes, in order to deliver the Ticket(s) to you and add you to our distribution list to propose you offers and other promotional or marketing activities and to provide you with the latest information about the Montreal Alouettes.  We remind you that if you wish that we discontinue use of your personal information, please Contact Us.

LIMITATION OF LIABILITY

Notwithstanding all security measures in place on the site, injury may occur during an event. By accepting the terms of the Agreement, you assume all risk, liability and responsibility for any and all damages of any nature suffered by you, including, without limitation, bodily harm and loss of property incurred during or in connection with the event. Furthermore, you hereby waive any and all rights to claim damages, monetary or otherwise, or to institute civil, criminal, administrative or legal proceedings against the Montreal Alouettes, its affiliates and other related entities or their directors, officers, administrators, employees, representatives and all other persons acting on behalf of the Montreal Alouettes, resulting from any cause whatsoever arising either before, during or after the event.

In certain cases, applicable laws may not allow the limitation of liability set forth above, so this limitation of liability may not apply in such particular cases.  If any part of this limitation on liability is found to be invalid or unenforceable for any reason, then the Montreal Alouettes aggregate liability (and that of its affiliates and other related entities or their directors, officers, administrators, employees, representatives and all other persons acting on behalf of the Montreal Alouettes) under such circumstances for liabilities that otherwise would have been limited shall not exceed one hundred Canadian dollars (CAN$100).

INDEMNIFICATION

You hereby agree to indemnify and hold harmless the Montreal Alouettes, its affiliates and other related entities, their directors, officers, administrators, managers, employees, representatives and all other persons acting on behalf of the Montreal Alouettes from and against any and all claims, actions, damages or other demands, including, but not limited to, reasonable costs and expenses of litigation such as counsel fees, arising from or relating to your purchase of Ticket(s).

APPLICABLE LAWS AND EXCLUSIVE JURISDICTION

The parties hereby agree that this Agreement shall be governed by and interpreted according to the laws applicable within the Province of Quebec in force at the time, without regard to conflict of law provisions.  Furthermore, the parties hereby elect to submit to the exclusive jurisdiction of the Courts of the Province of Quebec, in the Judicial District of Montreal, in respect of any action or proceeding arising out of or related to the Agreement. However, the foregoing clause is in force without prejudice to the rights of The Montreal Alouettes to obtain any protective proceeding such as an injunction from any competent court having jurisdiction.

TICKET CONDITIONS

The following paragraph appears on all printed Tickets and forms an integral part of the Agreement:

Important – This ticket is non-refundable and non-exchangeable. Upon cancellation of an event for which no other date has been selected, this ticket may be refunded pursuant to the conditions set forth by the Montreal Alouettes Football Club Company. Tickets may not be sold commercially without the expressed written consent of the Montreal Alouettes Football Club Company. Any organized promotional activity involving ticket draws or giveaways may not be undertaken without the expressed written consent of the Montreal Alouettes Football Club Company. Any falsification is prohibited. This ticket is void when declared, by the original holder, lost or stolen, or following a sworn complaint of theft to the local police station. The holder of this ticket assumes any and all liabilities as to the risks and dangers that may result from this event and waives any claim for loss or damage whatever the cause, incurred or suffered by the holder, whether occurring before, during or after the event. The ticket holder authorizes the Canadian Football League, the Montreal Alouettes Football Club Company, the visiting team and their agents to use his or her image if recorded, totally or in part, by videotape, picture or any other transmission or reproduction of the event which the ticket holder is allowed to attend, whether it is inside McGill’s Stadium, inside Douglas Hall and Tomlinson Hall or within the space dedicated to the tailgate held in front of the East entrance of the stadium. All fans entering Percival Molson Memorial Stadium may be searched by a security agent. It is forbidden to enter Percival Molson Memorial Stadium with alcohol, controlled or illegal substances and/or illegal drugs. Coolers, food and beverages purchased outside the stadium cannot be brought into the stadium. It is strictly forbidden to smoke in McGill, including cigars, cigarillos, cigarettes and electronic cigarettes.  For the security of all those in your section, the use of an umbrella is strictly prohibited within Percival Molson Memorial Stadium, rain or shine.  Fans must comply with all security agents and Montreal Alouettes representatives regarding stadium operations and emergency procedures. Management reserves the right to refuse access to the event or to evict any person whose behavior shall be deemed inadequate with or without refund of the price of the ticket. Non-compliant individuals may be ejected without warning and be subject to fines and further legal action.

 

GENERAL

Where a Court of Competent Jurisdiction declares a portion of the Agreement invalid or unenforceable, the remainder of the Agreement shall remain in force.

The headings in the Agreement are provided for clarity only and do not form an integral part of the Agreement.

Where you have read the Agreement in English, the Parties agree that the Agreement shall be drawn up in the English language. You can also read the Agreement in French.

The Montreal Alouettes takes your privacy and security of personal information very seriously. We have provided a secure environment and this strict Policy that describes the limited ways the information is used and the limited access to such information.

WHAT DOES THIS PRIVACY POLICY COVER?

This Policy covers the treatment of personally identifiable information (“Personal Information”) and other information gathered by the Montreal Alouettes when you are using or accessing the Services. This Policy also covers the Montreal Alouettes treatment of any Personal Information that the Montreal Alouettes may share with its business partners or other third parties under very limited circumstances.

This Policy does not apply to the general practices and treatment of information by third parties that the Montreal Alouettes does not own or control, including but not limited to any third party websites or services that you elect to access through the Services (“Third Party Services”), or to individuals that the Montreal Alouettes does not manage or employ. While we attempt to facilitate access only to those Third Party Services that share our respect for your privacy, we cannot take responsibility for the content or privacy policies of those Third Party Services. We encourage you to carefully review the privacy policies of any Third Party Services you access.

Without limiting the generality of the preceding paragraph, the Montreal Alouettes may use third-party ticket vendors (“Ticket Vendors”) for certain events and this Policy does not cover information submitted to these Ticket Vendors that the Montreal Alouettes does not control. However, these Ticket Vendors may transfer to the Montreal Alouettes certain Personal Information such as your email address, but only if you consent to such sharing by the Ticket Vendor at their website or through the use of their services. Furthermore, in the event of a cancellation, postponement, or other significant change to an event for which you purchased tickets through a Ticket Vendor, the Montreal Alouettes may request your full contact information in order to inform you of the change in the event information. In such a case, we will not use this Personal Information for any other purpose.

Finally, this Policy does not cover any Personal Information you send to the Montreal Alouettes via any non-secured mode of communications such as email, instant messenger or Twitter, as communications via these methods may be subject to interception, loss, or alteration. We encourage you to carefully examine what Personal Information you send to the Montreal Alouettes via these methods.

NO COLLECTION OF PERSONAL INFORMATION

The Montreal Alouettes does not, as a matter of course, gather any of your Personal Information while you are using the Services, unless you are asked to provide such information, for example by signing up to the mailing list. Where you have provided such information, it will only be used for the stated purpose.

Personal Information may be entered into the Website or App when you wish to connect to a third party service integrated into the Website or App, such as Facebook or Twitter (the “Integrated Third Party Services”) but this information is not in any way collected or stored by the Montreal Alouettes, and it is only used for the stated purpose, to sign in to the Integrated Third Party Service.

COLLECTION OF PERSONAL INFORMATION THROUGH THE TICKETING SYSTEM

When you use the Ticketing System to purchase tickets, the Montreal Alouettes collects the following Personal Information: name, email address, credit card information, and billing information including address and phone number. This information is only used for the following purposes: credit card processing; contacting you in the event of a cancellation, postponement, or other significant change to an event; and advertising or marketing purposes, but only upon your consent.

SECURITY OF INFORMATION

We use only industry best practices in keeping any data collected secure. This includes the HTTPS / SSL / TLS (Secure Socket Layer) protocol for all ticket-purchasing transactions and for authentication and data transfer to Integrated Third-Party Services. In addition, the Montreal Alouettes uses third party vendors and hosting partners to provide the necessary hardware, software, networking, storage, and related technology required to run the Services, and these vendors have been selected for their high standards of security.

LIMITED GATHERING OF INFORMATION FOR STATISTICAL AND SECURITY PURPOSES

The Montreal Alouettes automatically collects certain information using a third-party analytics program, Google Analytics, to help us understand how our users use the Services, but none of this information identifies you personally. NON-DISCLOSURE OF PERSONAL INFORMATION TO THIRD PARTIES

Except as provided in the next paragraphs, the Montreal Alouettes does not divulge any Personal Information gathered via the Services to third parties. Moreover, the Montreal Alouettes does not sell any information regarding its users to third parties. Only the employees, representatives, subcontractors, or officers of the Montreal Alouettes are responsible for the management and development of the Services, and only these individuals have access to the information collected there. These employees, representatives, subcontractors, or officers all have been instructed to comply with the Policy.

Notwithstanding anything in the Policy to the contrary, we may share any information we have collected about you or that you have submitted: (1) in response to subpoenas, court orders, or legal process, or to establish, protect, or exercise our legal rights or defend against legal claims or demands; (2) if we believe it is necessary in order to investigate, prevent, or take action regarding illegal activities, fraud, or situations involving potential threats to the safety of any person; (3) if we believe it is necessary to investigate, prevent, or take action regarding situations that involve abuse of the Services infrastructure or the Internet in general (such as voluminous spamming, denial of service attacks, or attempts to compromise the security of the Website infrastructure or the Services generally); (4) to a parent company, subsidiaries, joint ventures, or other companies under common control with the Montreal Alouettes (in which case we will require such entities to honour this Policy); (5) if the Montreal Alouettes is acquired by or merged with another entity (in which case we will require such entity to assume our obligations under this Policy, or inform you that you are covered by a new privacy policy); (6) when you explicitly consent to the providing of such information to third parties, such as our business partners, when it will only be used for the stated purpose.

In addition, the Montreal Alouettes uses certain Integrated Third Party Services to augment the Services. Personal Information is transferred from the Montreal Alouettes to the operators of these Integrated Third Party Services, but only to the extent required in order for them to function properly, and only upon your express submission of such information.

Finally, the Montreal Alouettes may transfer your email address to Facebook, but only for the purpose of creating a Facebook Custom Audience, in order to serve advertisements on Facebook that may be of interest to you. Please see the “Advertisements” section further in this Policy for more information.

REMOVAL FROM MAILING LIST AND DELETION OF PERSONAL INFORMATION

You may unsubscribe from the Montreal Alouettes mailing list at any time, by following the link at the bottom of all Montreal Alouettes emails. Note that unsubscribing from the mailing list in this manner may not necessarily delete all your Personal Information from the Montreal Alouettes databases. If you wish to ensure that all Personal Information is removed from our databases, please contact us.

The Montreal Alouettes uses tracking technology (“cookies”) on the Website and by using the Services you agree to their use. The Ticketing System uses certain session cookies such as waiting room position, the event requested, and the number of requests, but none of these cookies can identify you personally. Please note that deleting or refusing these session cookies may hamper your ability to properly purchase tickets through the Ticketing System, and the Montreal Alouettes disclaims all responsibility for any damages, pecuniary or non-pecuniary, resulting from your inability to purchase tickets if you delete or refuse such cookies.

In addition to the Montreal Alouettes session cookies on the Website and the Ticketing System, the Website also uses cookies from third parties including Doubleclick (a subsidiary of Google, for the serving of advertisements on the Website), and AddThis (for sharing of content via social media). There are also cookies used by YouTube, Facebook, and Twitter for various widgets and integration of content. The use of these third-party cookies is governed by their respective owners and the Montreal Alouettes has no control over them and disclaims any responsibility for their use. These cookies can be refused or deleted by your browser at any time, though deleting them may reduce or inhibit your use of certain third-party functionalities integrated into the Services.

ADVERTISEMENTS

The Montreal Alouettes currently uses Google AdWords and by using the Services you consent to this use. Specifically, the Montreal Alouettes uses the remarketing features of interest-based advertising of Google AdWords that delivers you advertisements that will be of particular interest to you, based on your browsing history at the Website. These advertisements will appear on third-party websites around the web. Google uses specific cookies to allow them to serve these ads around the web that will be of interest to you.

You may prevent this type of advertising by deleting the appropriate Google cookie through your browser, though this may not be permanent. For a more permanent solution, you may opt out of such Google advertising at any time by visiting your Google Ads Settings page.

The Montreal Alouettes may use your email address when creating Facebook Custom Audiences. We may submit your email address to Facebook in order to determine if you are a registered user of Facebook and if that is the case to display advertisements to you on Facebook that will be of interest to you. Facebook will not share that information with third parties, will maintain the strict confidentiality of the Custom Audience, and will immediately delete the data once it is determined if you are a registered Facebook user or not. If you do not want to receive such Facebook advertisements, please contact us.

The Montreal Alouettes reserves the right to use additional retargeting or other ad services in the future. In such a case, the Montreal Alouettes will update this section of the Policy with further details.

RISKS ASSOCIATED WITH THE INTERNET

Despite the Montreal Alouettes efforts to ensure third parties will not access or obtain your Personal Information through your use of the Services, complete confidentiality and security cannot currently be guaranteed on the Internet. Communication via the Internet is subject to interception, loss, or alteration. You acknowledge and agree that the Montreal Alouettes cannot be held responsible for damages resulting from the transmission of confidential information or Personal Information over the Internet and that such communications are at your own risk.

LIMITATION OF LIABILITY

The Montreal Alouettes, and / or its respective officers, directors, owners, officials, partners, partnerships, principals, employees, affiliates and other related entities, servants, agents, representatives, successors and assigns, will not be held liable for any damages resulting from the misuse of any information collected via the Third Party Services or by any third party, or any misuse of any information collected through the Website not in violation of the Policy.

SEASON TICKETS – MONTHLY PAYMENT PLAN

(payable up until November 15th 2019)

 

The purchaser authorizes the «Club de Football Alouettes de Montréal» or his assignee to charge the total amount for his/her 2019 season tickets on the credit card on file, and this according to the number of predetermined monthly payments. The total amount for the season tickets that will be payed by monthly instalments has to be completely payed before November 15th 2019.

Example: If a person chooses this option for the first time on the 15th of December 2018, they will have to pay the total amount (by monthly instalments) before the 15th of November 2019. To attain this completion of payment, there will be 10 monthly automatic withdrawals from December 2018 to September 2019.

To all those who take this option, the «Club de Football des Alouettes de Montréal are happy to introduce an all new feature with regard to season ticket renewals

There will be an automatic renewal for each football season from the 15th of October to the 15th of September of each following year. You will have the opportunity to renounce your automatic renewal between the 15th of August and the 15th of September of each year.

As such, pre-authorized withdrawals will be cancelled for the following season.

It is important to note that the advantage of automatic renewal is only for the following season, the total amount will be payed over a period of 12 months.
